How does HIM process WorkSafe BC requests?

We understand the importance of timely processing of health record requests for claims and workplace accident investigations.

Records Management will release the health information of individuals who are injured on the job or who have a work-related illness to process or adjudicate claims, or to coordinate care under workers' compensation systems (e.g. WorkSafe BC).

WorkSafe BC (Claim Investigations)

Processing time: Within 10 days

Consent Requirements
Written request with patient or patient's designated decision maker consent preferred. Often a patient's consent is provided; however it is not mandatory – under the Workers Compensation Act (Section 75, 79 and 342).

Limited information can be released without patient consent in order to obtain payment from WorkSafe BC (i.e. listing of dates of admission and procedures performed).

In the case of a deceased person's records, a WorkSafe BC representative must provide written copy of the appropriate consent, such as a copy of the Will confirming the executor for the deceased's estate or nearest relative.

WorkSafe BC (Incident Investigations)

Processing time: Same day or within 10 days

Consent Requirements
No explicit patent consent is required. The officer is required to present valid WorkSafe BC identification. In most instances, the officer will also present a written or faxed letter of delegation.
