How does HIM process legal requests?

Records Management may release patient information to lawyers and other parties when requested to do so only if the patient or the patient's designated decision-maker has given consent, preferably in writing, or if authorized by law or a court order.

Types of health documents released

  • Clinical notes;
  • Investigation reports and results; and
  • Consultation reports. 
If there is sensitive information included which is not directly relevant to the request our staff will ensure that only pertinent information is released.

Lawyers (not representing the patient)

Processing Time: Within 30 business days
Fees
  • Flat Processing Fee
  • Photocopying Extra Pages (>20 pages)
  • Rush
  • Certification
  • Page Numbering
  • Single-Sided Copies (if requested)
  • Off-Site Retrieval (if rush)
Please note: If a lawyer is requesting records pertaining to anything other than health information, we will forward these requests to the appropriate Health Authority's Information Access & Privacy Office.

Law Firm and/or Hospital Insurance Adjuster as per Risk Management/Integrated Risk Management

Turnaround Time: As specified by Risk Management/Integrated Risk Management.
No patient consent is required to release to our Health Authority lawyers or insurance adjusters, as long as the request comes through Risk Management/Integrated Risk Management.
